1. Agreement to Terms

By accessing or using Profixo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Profixo is a Shopify application that analyzes your store's profitability, identifies profit leaks, and provides actionable recommendations to improve your business performance.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the authority to enter into this agreement. You must own or have authorization to connect the Shopify store you register.

3.2 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service without permission
• Resell or redistribute the Service
• Upload malicious code or viruses

5. Shopify Integration

5.1 Authorization

By connecting your Shopify store, you authorize us to access your store data through the Shopify API with read-only permissions for products, orders, and analytics.

5.2 Data Access

We only request the minimum permissions necessary to provide our service. We cannot modify your store data, products, or orders.

6. Subscription and Billing

6.1 Free Trial

We may offer a free trial period. After the trial ends, you will be charged according to your selected plan unless you cancel.

6.2 Subscription Fees

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

6.3 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increases.

7. Cancellation and Termination

7.1 Your Rights

You may cancel your subscription at any time. Your access will continue until the end of your current billing period.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with notice.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Profixo and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFIXO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold Profixo harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

13. Modifications to Service

We reserve the right to modify or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification or discontinuation.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Profixo operates, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
